2 Data protection: a general overview

Below you will find information on the most important key points of our data processing. You will then find more detailed information about the processing we carry out.


2.1 Personal data processed by us and its origin

We use the personal data that you provide to us, that we collect about you or that we receive from third parties. This refers, in particular, to personal data:


 that we receive from customers, prospective customers, interested parties, tenants, prospective tenants, service providers, suppliers, business partners or other persons involved in the business relationship in the context of our business relationships;


 that we receive from job applicants;


 that we receive from trade fairs/competitions;


 that we collect through the use of technical aids (GPS, tracker, video, etc.); that we are legally or contractually obliged to collect; that we obtain when you visit our website. );

 Financial data, such as account information, payment information, payment history, average revenue;

 Telecommunications traffic edge data, such as telephone number, value-added service numbers, date, time and duration of connection, connection type, location data, IT usage data, IP address, device identification numbers such as MAC address;

2.2 Objectives and legal bases for processing

We use the personal data we collect primarily to conclude and process contracts with our customers and business partners and to fulfill our legal obligations (e.g. storage of accounting-related documents).


We also rely on the processing of personal data for the purchase of products and services from our suppliers and subcontractors. If you work for a client or business partner, your personal data may also be affected in this capacity.


In addition, we process your personal data and those of other persons, to the extent that we permit and deem appropriate, also for the following purposes, in which we (and sometimes third parties) have a legitimate interest corresponding to the purpose:


    Offering and further developing our products, services, website and other platforms on which we are present;


 Communication and processing of requests (e.g. via contact forms, e-mail, telephone [call center], job applications, media requests);


 Advertising and marketing, provided that you have consented/not objected to the use of your data;


 Assertion of legal claims and defense in connection with legal disputes and official proceedings;


    Compliance with laws, guidelines and recommendations of authorities;


 Risk management;


 For education, training and quality assurance purposes;


 Prevention and investigation of criminal offenses and other misconduct (e.g. conducting internal investigations, data analysis to combat fraud);


 Guarantees of our operations, in particular IT, our website and other platforms.


If you have given us your consent to process your personal data for specific purposes, we will process your personal data within the scope and on the basis of that consent, unless we have another legal basis and require it. The consent given can be revoked at any time, but this has no effect on the data processing already carried out. You can send us a revocation by e-mail or by post to the (e-mail) address provided in 1 .


2.3 Third parties to whom we disclose personal data

We treat your personal data confidentially and only pass it on if you have consented, if we are legally obliged or authorized to do so or if this is necessary to enforce our rights, in particular to assert claims arising from the contractual relationship. Under no circumstances will we sell your data.


We also disclose personal data to third parties in the context of our business activities and for the purposes mentioned above, insofar as this is permitted and appropriate, either because they process it for us (order processing) or because they wish to use it for their own purposes (data disclosure). This refers in particular to


 Service providers, including processors;


 IT service providers (e.g. web hosting providers, email service providers, online tools);


 Suppliers;


 Credit rating company;


 Authorities;


 Insurance;


 Banks and payment service providers;


 Collection partners;


 Public authorities and courts.


It goes without saying that the legal regulations on the transfer of personal data to third parties are complied with. If we use processors to provide our services, we will take appropriate legal precautions and appropriate technical and organizational measures to ensure the protection of your personal data in accordance with the relevant legal provisions.


Some of the beneficiaries are in Germany, but others are also abroad.


2.4 Data processing site

In principle, we process personal data in Switzerland or in an EU/EEA country or another country that has an adequate level of data protection. In relation to certain processing operations, you should expect your data to be transferred to other countries within and outside Europe, where some of the IT service providers we use are located. We will not disclose data to a country that does not have an adequate level of data protection (e.g. the United States of America).


2.5 Duration of data processing

We process personal data for as long as is necessary for the fulfillment of our contractual obligations or otherwise for the purposes pursued with the processing, e.g. for the duration of the entire business relationship and beyond, in accordance with legal retention and documentation obligations. It is possible that personal data will be stored for as long as claims can be made against us and insofar as we are legally obliged to do so or legitimate interests so require (e.g. for evidence and documentation purposes). As soon as your personal data is no longer required for the purposes mentioned above, it will generally be deleted or made anonymous.


2.6 Data security

We adopt appropriate technical and organizational security measures to protect your personal data and continuously improve them in line with technological developments. This includes protection against accidental or intentional manipulation, loss, destruction or unauthorized access by third parties, such as the use of recognized encryption methods (e.g. encryption using TLS).


The measures taken are intended to guarantee the confidentiality and integrity of your data and to ensure the long-term availability and resilience of our systems and services when processing your data. They are also intended to ensure the rapid restoration of the availability of your data and access to it in the event of a physical or technical incident.


Our employees and service providers contracted by us are obliged to maintain confidentiality and comply with data protection regulations and only have access to your personal data if this is necessary.


2.7 Your rights

In principle, you have the right to information, rectification, erasure, restriction, data portability and objection to the processing of your personal data.


If you have given us your consent to process your personal data for specific purposes, you also have the right to revoke this consent at any time. However, such revocation has no effect on data processing that has already taken place.


Please note that we reserve the right to enforce restrictions provided for by law, for example if we are obliged to store or process certain data, if we have an overriding interest in doing so (provided we have the right to invoke it) or if we need it for the assertion of claims.


Please also note that exercising these rights may conflict with contractual agreements and may have consequences, such as premature termination of the contract or cost consequences. We will inform you in advance if this is not already contractually regulated.


Exercising your rights under data protection law generally requires you to clearly prove your identity (for example, by providing a copy of your identity document when your identity is unclear or cannot be verified). To assert your rights, please contact us at the (e-mail) address specified in section 1.

If you believe that the processing of your personal data violates data protection law or that your data protection rights have been infringed in some other way, you can also lodge a complaint with the competent supervisory authority. In Switzerland, this authority is the Federal Data Protection and Information Commissioner (FDPIC).


3 Data protection: the details
3.1 Provision of contractual services

We process personal data to the extent necessary in each case to provide you with our contractual or pre-contractual services and to perform other services requested by you, in particular transportation and logistics services and customs clearance. The data processed in this context, the type, scope, purpose and necessity of their processing are determined by the underlying contractual relationship.


The data processed includes, in particular, contact and identification data, contract data and financial data.


Data is deleted when it is no longer required for the fulfillment of contractual or legal obligations. Otherwise, statutory retention obligations apply.


3.2 Carrying out credit checks

If we make advance payments, for example in the case of a purchase on account, we may obtain credit information from a credit agency on the basis of mathematical-statistical procedures to protect our legitimate interests. For this purpose, we transmit the personal data required for a credit check to a credit agency and use the information received on the statistical probability of payment default for a balanced decision on the establishment, execution or termination of the contractual relationship. The credit report may contain probability values (score values) that have been calculated on the basis of scientifically recognized mathematical-statistical procedures and whose calculation includes address data. Your interests worthy of protection are taken into account in accordance with legal provisions.


3.3 Application for employment

When you apply for a job with us, we process the personal data that we receive from you as part of the application process or that you enter or upload into the application form. In addition to your personal data, education, professional experience and skills, this includes the usual correspondence data such as e-mail address and telephone number. In addition, all documents submitted by you in connection with the application, such as CVs and certificates, will be processed. This data will only be stored, analyzed, processed or forwarded internally as part of your application.


Your applicant data is stored separately from other user data and is not merged with it.


Your applicant data is processed to fulfill our (pre-)contractual obligations as part of the application process.


You can object to this data processing at any time and withdraw your application. Please send your objection to the person indicated as contact in the job advertisement or to the (e-mail) address provided in 1.

If we conclude an employment contract with you, the data transmitted will be stored for the purpose of processing the employment relationship in accordance with legal provisions. If the application process ends without employment, your personal data will be stored for up to six months for documentation purposes and then deleted, unless you have given us your consent to store your data for a certain period of time for further application processes.


You have the option to revoke this consent at any time. You can send your revocation to the (e-mail) address indicated in1 or to the person indicated as contact in the job advertisement.



Visiting our websites
4.1 Server log files

When you visit one of our websites, our servers temporarily store each access in a log file, so-called server log files.


For example, your IP address, the date and time of the visit, the name of the file accessed, the status of the access (completed, partially completed, not completed, etc.), the web browser and operating system used and other similar information used for security purposes in the event of attacks on our information technology systems are recorded.


Before we save your IP address, it is anonymized and not merged with other data. No personalized analysis is carried out.


This information is processed on the basis of our legitimate interests and is for the purpose of correctly displaying the website you have visited and its content and offers, ensuring data traffic and optimizing our websites, content and offers, permanently ensuring the stability and security of our websites and systems and enabling the investigation, defense and prosecution of cyber attacks, spam and other unlawful acts in relation to our websites and systems and the enforcement of claims in this regard.


We delete your personal data as soon as it is no longer necessary to fulfill the purpose for which it was collected. In the case of data collection for the provision of our websites, deletion takes place when the respective session is terminated.


For the hosting of our websites, we may use the services of third parties in Switzerland and abroad who carry out the aforementioned processing on our behalf. At present, all our websites are hosted exclusively by Swiss hosting providers and on servers in Switzerland.



4.2 How to get in touch

Most of our websites offer the option of contacting us via various online forms, by telephone and/or by e-mail. In some cases, it is also possible to contact us via online chat.


If you contact us via the online form, the details of the form, including the contact details you provide, will be stored by us for the purposes of processing your request (e.g. removals, international transport, customs clearance inquiries) and in the case of subsequent inquiries, and will not be passed on to unauthorized third parties without your consent.


The basis for processing your personal data is our legitimate interest in processing your inquiry. If contacting us serves to fulfill a contract to which you are a party or to implement pre-contractual measures, this is an additional basis for processing your personal data.


You can object to this data processing at any time. Send your objection to the (e-mail) address indicated in1 and we will analyze your request. In this case, your contact will no longer be processed.


Your personal data will be deleted as soon as your request has been fulfilled. This is the case if it can be inferred from the circumstances that the matter in question has been conclusively clarified and that the deletion does not conflict with any legal retention obligations.


4.3 Newsletter

On some of our sites, you have the option of subscribing to our newsletter. To do this, please fill in the form with the mandatory information required, in particular your e-mail address. We need this information to send you the newsletter you want and to address you personally. Information on the content of the newsletter you have requested can be found on the relevant registration form.


Registration for our newsletters is done using the so-called double opt-in procedure. This means that, after registering, you will receive an e-mail in which you have to click on a link to confirm your registration.


Some of our newsletters may, where permitted, contain graphics and/or web links that record whether, when and how often an individual newsletter was opened in an email application and which web links were clicked on. These graphs and/or web links record the use of newsletters to ensure quality and enable improvements to the newsletter. It is possible to block the setting of such graphics and/or web links in your email application.


You can unsubscribe from the newsletter at any time, free of charge, and revoke the consent you have given. To do this, click on the corresponding unsubscribe link at the end of each of our newsletters.


5 Cookies

We may use so-called cookies on our websites. Cookies are small text files that are placed and stored on your end device (laptop, tablet, smartphone etc.) with the help of your browser. They are used to make our websites more user-friendly and effective in general and to make your visit to our websites as pleasant as possible. Cookies do not cause any damage to your end device. They cannot run programs or contain viruses.

Regardless of whether the processing is based on consent or legal permission, you have the option at any time to revoke your consent or object to the processing of your data by cookie technologies. You can configure your browser so that it informs you about the setting of cookies and you can allow the acceptance of cookies for certain cases only in individual cases or exclude them generally. You can also activate the automatic deletion of cookies when you close your browser. In addition, you can delete cookies that have already been set in the browser at any time.
